These terms are the agreement between you and Shaanxi Hengchang Yaohua Development Co., Ltd. ("DearFam AI", "we") for the DearFam AI service. By opening an account you accept them. If you do not accept them, do not use DearFam AI.
DearFam AI is a small shared record for a family. One adult opens an account and pays for it. The older people in the family open a link, see one screen, and can tap a button once a day. The family can add short notes and see that the day was marked. That is the whole of the service.
DearFam AI is a way to stay in touch. It is not a safety system. Please read section 7 before you rely on it for anything.
DearFam AI costs US$7.99 per month, or US$79 per year if you choose the yearly plan. Prices are in US dollars and exclude any sales tax or VAT that applies where you live; tax is added at checkout and shown before you pay.
Your subscription renews automatically. When you pay, you agree that we (through our payment processor) may charge the same card, for the same amount, at the start of every month or every year, until you cancel. We will email you before the first charge and, if the price ever changes, at least 30 days before the change.
You can cancel at any time from the billing page in your account. Cancelling takes the same number of clicks as signing up — there is no phone call, no email to write, and no reason you have to give. When you cancel, the subscription stops at the end of the period you have already paid for, and you keep full use of DearFam AI until that date. We do not delete your family's records when you cancel.
If a payment fails we will tell you and try again for a short period. If it still fails, the paid features pause; records are kept, not deleted, for at least 90 days.
Refunds are governed by our Refund Policy, which forms part of these terms.
If you do any of these things we may suspend the account. Where it is reasonable to do so, we will tell you why first.
The names and notes you enter stay yours. You give us only the permission we need to store them and show them to your family and to you — nothing more. We do not use them for advertising or to train third-party AI models.
DearFam AI is not a medical device, not a health monitor, and not an emergency service. It does not detect falls, measure anything about a person's body, or watch for danger.
Specifically, and without limiting the above:
If someone may be in danger, call the emergency number where they live (911 in the United States) or go to them. Do not wait for DearFam AI.
We try to keep DearFam AI running, but we do not promise it will be uninterrupted or free of faults. We may change or remove a feature. If we remove something substantial, or shut the service down, we will give you at least 30 days' notice by email and a way to export your family's records.
To the extent the law allows: we are not liable for indirect or consequential losses, or for loss of profit, goodwill, or data. Our total liability to you for any claim connected with DearFam AI is limited to the amount you paid us in the twelve months before the claim arose.
Nothing in these terms limits liability that cannot lawfully be limited — including, in places where such rights exist, liability for death or personal injury caused by our negligence, or for fraud.
If you are a consumer, you keep all the statutory rights your local law gives you. Nothing here takes them away.
You may stop using DearFam AI at any time and delete your account from the billing page. We may end this agreement if you seriously or repeatedly break these terms, or if we are required to by law. If we end it without cause, we will refund the unused part of your period.
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. If you are a consumer living elsewhere, this choice does not remove the protection of the mandatory consumer law of the country where you live, and you may bring a claim in your local courts.
We may update these terms. If a change materially affects your rights, we will email you at least 30 days before it takes effect. If you do not agree, you can cancel before it starts.
